How to choose I-9 & E-Verify software

The software does not make you compliant. It reduces errors and makes your records retrievable, so choose for audit trail integrity, error prevention and clean exits from the system.

Ask each vendor to map its product to the USCIS electronic system requirements in writing.

  1. Audit trail

    USCIS says an electronic system must create a secure, permanent record of who created, updated or corrected a form, when, and what they did.

  2. Integrity and security controls

    The system must have reasonable controls to prevent and detect unauthorized or accidental creation, alteration or deletion of stored forms, and limit access to authorized staff.

  3. Indexing and retrieval

    Employers must be able to identify and retrieve records and reproduce legible paper copies, and must keep a description of the system and indexing available on request.

  4. Error prevention and correction

    Most paperwork problems are avoidable data errors, such as missing dates or mismatched documents.

  5. Deadline tracking

    Section 1 is due no later than the first day of employment and Section 2 within three business days of the first day.

  6. E-Verify integration

    E-Verify is free and voluntary for most employers, but some are required to use it by state law or federal regulation. Integration saves rekeying data.

    Watch out for

    • Per-form fees that spike with seasonal hiring
    • Minimum contract terms for rarely used accounts
    • Support limited to documentation when a case is complicated

    • HRIS and ATS integration so data is not rekeyed
    • Role-based access and location-level reporting
    • Remote hire workflows with an authorized representative
    • Bulk correction and purge tools

    Watch out for

    • Integrations that only sync one direction
    • Audit reports that need vendor assistance
    • Inconsistent practices across sites that the tool does not surface
  • Enterprises

    • Single sign-on and granular permissions
    • Centralized dashboards across entities and sites
    • Documented system description and quality assurance program
    • API access and E-Verify at scale

    Watch out for

    • Acquired entities with legacy paper files that need migration
    • Data residency and retention conflicts with other systems
    • Vendor change management for form updates

Red flags

  • The vendor cannot show an audit trail for a corrected form.
  • Administrators can overwrite or delete a completed form without a record.
  • Compliance is described as guaranteed rather than mapped to specific USCIS requirements.
  • You cannot export forms with audit history in a standard format.
  • E-Verify is advertised as a paid feature, although E-Verify itself is free.
