Who needs leave of absence & accommodations software?

You need leave of absence tooling when protected leave stops being an occasional event and becomes a steady caseload. The usual triggers are crossing into FMLA coverage, hiring in states that run their own paid family and medical leave programs, a rise in intermittent leave, or an accommodation request that HR could not document cleanly.

The Family and Medical Leave Act covers private-sector employers with 50 or more employees in 20 or more workweeks in the current or previous calendar year, and all public agencies. Eligible employees can take up to 12 workweeks of job-protected leave in a 12-month period for qualifying reasons, with group health coverage continued on the same terms, and may take leave intermittently or on a reduced schedule when medically necessary. The Department of Labor's employer notice rules set deadlines too: an eligibility notice within five business days of the leave request, and a written designation notice within five business days, absent extenuating circumstances, once the employer has enough information to decide whether the leave qualifies.

Accommodations run alongside leave. The EEOC describes an informal, interactive process for identifying a reasonable accommodation under the ADA, and treats leave itself as a possible accommodation. The Pregnant Workers Fairness Act requires employers with 15 or more employees to provide reasonable accommodations for known limitations related to pregnancy, childbirth or related medical conditions, unless that causes undue hardship. Several states and the District of Columbia have also created paid family and medical leave programs, so the rules that apply depend on where each employee works.

A small employer that is not covered by the FMLA and rarely handles extended leave can often manage with a written policy, a calendar and counsel on call. Buy a tool when leave volume, multiple states or intermittent leave make tracking by spreadsheet unreliable.

How to choose leave of absence & accommodations software

Leave tools differ most in the depth of their rules engine and in who does the work. Some give your HR team software to run leave in-house; others pair the software with a vendor team that handles cases for you. Decide which model you want before you compare features.

Bring real, anonymized cases to the demo: an intermittent leave, an employee in a state with its own paid leave program and an accommodation request. Ask the vendor to walk each one from request to return to work.

  1. Federal, state and local leave law coverage

    FMLA is only one layer. State family and medical leave laws, paid leave programs and local rules can apply to the same absence, and the tool has to run them together.

  2. Eligibility determination

    FMLA eligibility depends on employer coverage, length of service, hours worked and the number of employees near the worksite, which is hard to calculate by hand.

  3. Notices and deadlines

    The Department of Labor sets deadlines for eligibility, rights and responsibilities, and designation notices, and late or missing notices are a common gap.

  4. Intermittent leave tracking

    Intermittent and reduced-schedule leave is taken in small increments that are easy to miscount, especially for employees with variable schedules.
