Who needs i-9 & E-Verify software?

You need dedicated I-9 software when paper forms are scattered across sites, when hiring is distributed or remote, or when you cannot say how many forms are incomplete or overdue for purging. Every hire must have a Form I-9, so volume and turnover drive the risk.

Government inspectors can request forms, and employers must be able to present them within 3 business days. Searching filing cabinets is hard to do in that window.

A lighter option can be enough for a small employer with a handful of hires a year, one location and a trained person completing Section 2. The module inside an onboarding or HRIS platform may also cover you, if it meets the same electronic system requirements.

How to choose i-9 & E-Verify software

The software does not make you compliant. It reduces errors and makes your records retrievable, so choose for audit trail integrity, error prevention and clean exits from the system.

Ask each vendor to map its product to the USCIS electronic system requirements in writing.

  1. Audit trail

    USCIS says an electronic system must create a secure, permanent record of who created, updated or corrected a form, when, and what they did.

  2. Integrity and security controls

    The system must have reasonable controls to prevent and detect unauthorized or accidental creation, alteration or deletion of stored forms, and limit access to authorized staff.

  3. Indexing and retrieval

    Employers must be able to identify and retrieve records and reproduce legible paper copies, and must keep a description of the system and indexing available on request.

  4. Error prevention and correction

    Most paperwork problems are avoidable data errors, such as missing dates or mismatched documents.

  5. Deadline tracking

    Section 1 is due no later than the first day of employment and Section 2 within three business days of the first day.

  6. E-Verify integration

    E-Verify is free and voluntary for most employers, but some are required to use it by state law or federal regulation. Integration saves rekeying data.

Red flags

  • The vendor cannot show an audit trail for a corrected form.
  • Administrators can overwrite or delete a completed form without a record.
  • Compliance is described as guaranteed rather than mapped to specific USCIS requirements.
  • You cannot export forms with audit history in a standard format.
  • E-Verify is advertised as a paid feature, although E-Verify itself is free.

Frequently asked questions

Do I need I-9 software?

No law requires software, because paper Forms I-9 are valid. You need it when volume, remote hiring or multiple sites make paper hard to control. Electronic systems must still meet USCIS requirements, including an audit trail, access controls and the ability to produce legible copies on request.

What is E-Verify and is it free?

E-Verify is a federal online service that electronically confirms new hires' employment eligibility against government records. Using it is free. Participation is voluntary for most employers, though some are required to use it by state law or federal regulation.

How long do I have to keep Form I-9?

Keep each form for three years after the date of hire or one year after employment ends, whichever is later. A system that calculates purge dates reduces the risk of keeping forms too long or discarding them too early.

What are the deadlines to complete Form I-9?

The employee completes Section 1 no later than the first day of employment. The employer completes Section 2 within three business days of the first day of work. Software can track these deadlines, but you are responsible for meeting them.

I-9 software vs. a paper process: which is better?

Electronic is better when you hire often, at several sites or remotely, because validation, audit trails and indexing reduce errors. Paper can work for a small employer with few hires. In both cases, the same retention and inspection rules apply.

How fast must I produce I-9s in an inspection?

Employers must present Forms I-9 for inspection within 3 business days of the request, according to USCIS. Test this before you need it: ask your vendor to show how to retrieve and print a defined set of forms.

Is I-9 software worth it for a small business?

It is worth it if errors or lost files are a real risk, and if the per-form price fits your hiring volume. If you hire a few people a year, a documented paper process with a trained reviewer may be enough.
