Who needs ACA compliance software?
You need it if you are an applicable large employer, meaning at least 50 full-time employees including full-time equivalents on average during the prior year. A full-time employee averages at least 30 hours of service per week or 130 hours per month.
Variable-hour workforces, multiple entities under common ownership and several benefit plans make manual tracking error-prone. Related companies are generally combined to determine status.
If you are below the threshold and have no reporting obligation, you do not need it. Employers filing only a few forms may handle them through a payroll or benefits platform that includes ACA reporting.
How to choose ACA compliance software
The cost of an ACA error is a payment calculated per employee, so the platform's ability to track hours and test offers accurately matters more than the filing screen.
Ask for a sample file that includes variable-hour employees, a mid-year hire and a coverage change.

Who must file Form 1095-C?

What is the penalty for not offering coverage?
Under section 4980H(a), an employer that does not offer coverage to at least 95 percent of full-time employees owes a payment if at least one full-time employee receives a premium tax credit. A second payment applies when coverage is offered but unaffordable or inadequate. Amounts are indexed annually.
