Employer of Record (EOR)

Best Employer of Record (EOR) Services in Germany

Germany treats most employer of record set-ups as temporary agency work. Under the Temporary Agency Work Act (AÜG), placing an employee in another company's work organization, under its instructions, needs a permit, and the same worker may not be assigned to the same client for more than 18 consecutive months. These checks decide whether a German hire stays lawful.

How the score works

What matters in employer of record (EOR) services in Germany

  1. An agency work permit (AÜG)

Ask whether the provider's German employing entity, or the partner it uses, holds the AÜG permit, and ask for a copy. If the arrangement needs a permit and has none, the law can treat the worker as employed by your company from the start.

  2. A plan for month 18

Earlier assignments to your company count in full unless the break between them is longer than three months. Agree in writing what happens before the limit: a move to your own German entity, a contractor review, or the end of the role.

  3. Equal pay with your own staff

The Act gives an assigned worker the same basic working conditions, pay included, as a comparable employee of the client, unless a collective agreement applies. Ask how the provider sets pay when you have no German staff to compare with.

  4. Construction and works council rules

Temporary agency work is generally prohibited for work normally done by workers in construction sector establishments, and a client's works council must be consulted before an assigned worker starts. Tell the provider about both before the offer goes out.

Frequently asked questions

Is an employer of record legal in Germany?

Yes, with a condition. When the worker is integrated into your work organization and follows your instructions, German law treats the arrangement as temporary agency work, and the employing company needs a permit under the Temporary Agency Work Act (AÜG). Ask the provider which German entity employs your hire and whether it holds that permit.

How long can I employ someone in Germany through an EOR?

Up to 18 consecutive months with the same client when the arrangement counts as temporary agency work, unless a collective agreement sets another limit. Earlier assignments count in full if the gap between them is three months or less. A contract that runs past the limit is invalid, and the worker becomes your employee unless they object in writing within one month.

How much does an EOR cost in Germany?

Three parts: the provider's monthly fee, the gross salary, and the employer's share of social insurance, which in 2026 includes 9.3% for pension and 1.3% for unemployment insurance, plus about half of health and long-term care insurance. Compare the published fees in the ranking on this page, and ask each provider for an all-in quote in euros for the same salary.

What are the best employer of record (EOR) services in Germany?

On the LeadChange Score weighted in Germany, the highest-scoring of the 7 products with a published score are Remote (9.2/10), Velocity Global (8.8), and Deel (8.7).

That is 7 of the 12 products in Germany.
